Will
The following transcript was found in the
*ABH research notes:
"
THIS IS THE LAST WILL AND TESTAMENT of me MABEL BARTON of Scar Close, Warton, near Carnforth, in the County of Lancaster, Spinster.
1. I hereby revoke all Wills and testamentary instruments heretofore made by me.
2. I appoint my Sister Ethel Barton, John Robert Hall of Carnforth aforesaid and Allan Sewart of Lancaster in the County of Lancaster, Solicitor, (hereinafter called "my trustees") to be the Executors and trustees of this my Will.
3. In exercise of the power for this purpose conferred on me by the Will dated the twentieth day of January one thousand nine hundred and twelve of my father Edward Barton who died on the sixteenth day of October last, I hereby appoint that the trustees or trustee for the time being of the said Will shall stand possessed of my share (both original and accruing) of the residuary trust funds mentioned and referred to as such in the said Will In trust for my said sister Ethel Barton for her own use absolutely.
4. I bequeath to my trustees all my jewelry, brooches and other articles of personal use or adornment, furniture and household effects, and animals (other than my grey hunting horse 'Viceroy' hereinafter mentioned) with the request that they will dispose of the same in accordance with any memorandum or paper signed by me and deposited with this my Will or left among my papers at my death but such memorandum or paper shall not be deemed to form part of my Will or have any testamentary character and the expression of my wishes as to the disposal of the said articles and effects shall not create any trust or legal obligation even if the same shall be communicated to either of them my trustees in my lifetime. That in the absence cf any such memorandum or paper, I direct that the said articles shall fall into and form part of my residuary estate.
5. I bequeath to my trustees my said horse "Viceroy" Upon trust and I direct that they my trustees shall as soon as possible after my death have my said horse shot and buried in the valley in B..... on Warton Crag, Warton aforesaid.
6. I give the following legacies free of duty: namely, the sum of fifty pounds to the said John Robert Hall; the sum of one hundred pounds to each of the following Societies or Institutions namely The House for Lost Hogs (sic), B.... The Royal Society for the Prevention cf Cruelty to Animals (both Lancastershire and Border branches) and the House of Rest for Horses, West Croft Farm, Chicklewood, London III, and the sum of two hundred pounds .... Hutch Friends League to provide one or more horse ambulances in some large town or towns.
7. And I declare that the receipt of the respective treasurers for the time being of the said Societies or Institutions shall be a sufficient discharge for the said legacies respectively.
8. I leave this money to horses and hogs (sic) because all my life I have been much indebted to them for service and companionship.
9. I give all my property both real and personal not hereby otherwise disposed of subject to the payment of my funeral and testamentary expenses and debts and the legacies bequeathed by this my Will or any Codicil hereto and the duty on any legacies bequeathed free of duty to my said Sister Ethel Barton for her own use absolutely.
10. And I declare that the Executors and trustees for the time being of this my Will may instead of acting personally employ and pay a Solicitor or other person to transact any business or do any act cf whatsoever nature required to be done in connection with the administration of my estate or the trusts hereby declared including the receipt and payment of money and that any Executor or trustee hereunder being a Soliciter or other person engaged in any profession or business may be employed or being a sole executcr or trustee may so act and shall be entitled to charge and be paid for all work done and time expended by him or his firm in relation to the Executorship or trust including any act which an Executor or trustee not being a Soliciter or other person engaged as aforesaid could have done personally.

This is a Codicil to the Will of me, MABEL BARTON of Scar Close, Warton, in the County of Lancaster, Spinster, which Will bears the date the fourteenth day of February One Thousand nine hundred and fifteen.
I bequeath to my sister in law Margaret Barton an annuity of two hundred pounds free from death duties commencing from my death to be payable by equal half yearly payments and the first payment thereof to be made at the expiration of six calendar months from my death. And I authorize the trustees of my said Will in case at any time with a view to the due administration or distribution of my estate or for any other reason it should be declared by my said trustees convenient so to do purchase an annuity in the name of my said sister in law (if the case shall so require) in the names of my said trustees from Government or any public company for the purpose of answering or satisfying the said annuity so bequeathed to her as aforesaid.
I declare any annuity so purchased in the names cf my said trustees shall be paid or applied by them to my said Sister in law in the same manner in which the annuity ..... of which the same was as hereinbefore directed to be paid. And in all other respects I confirm my said Will.

This is a SECOND CODICIL of me, MABEL BARTON of Scar Close, Warton, in the County of Lancaster, Spinster which Will and the First Codicil hereto both dated the 14th day of February One Thousand nine hundred and fifteen.
I bequeath to my gardener, Brachsbarth [?]
the sum of thirty pounds free of duty to make In all other respects I confirm as altered by the said first Codicil thereto.
